What Should I Ask an Attorney in my Divorce without Kids Consultation?

First of all, let me thank you personally for giving us the opportunity to meet with you and discuss your important legal case. We know that divorce can be very stressful. We hope that when we meet with you, we can give you a little bit of peace of mind and certainly some legal advice that will help you understand the divorce process in greater detail and help you understand what to expect as you go forward. In order to maximize your time with us, I wanted to send this video to you to discuss some important questions that we will be discussing when we meet, and to give you an opportunity to think about those questions and come prepared to discuss them. In a divorce case where kids are not involved, we primarily discuss the issues of division of property, division of debt, and sometimes spousal support.

When it comes to division of property, one of the most important questions that we talk about is whether or not a particular asset or a particular piece of property is a community asset or a sole and separate asset. What I would ask you to do in order for us to understand your situation as best as possible is to come prepared with an inventory of all of your assets. This would include any bank accounts, investment accounts, retirement accounts, vehicles, boats, real property, etc. We know that that could be a long list, but if we understand what assets we’re talking about, it will help us give you the best advice possible. Another question to come prepared to discuss is when were these assets acquired. Understanding when they were acquired and how they were acquired helps us analyze whether a particular asset would be considered as a sole and separate asset in Arizona or community asset. Debts are treated the same way, so if you’ll do the same thing with debts, that will once again help us understand how the courts may divide your debts at the time of your divorce. If you can come prepared with a list of debt including credit card debts, auto loans, school loans, medical debts, etc, and once again when were they acquired and how were they acquired.

Finally, if you’re in a situation where we need to talk about spousal maintenance, important questions are going to be what is your budget, how much money do you think you’re going to need in order to meet your monthly expenses, what is your work history, how much money have you made in the past, how long do you think you’re going to need financial assistance from your spouse and do you have any specific plans to go back to school or get any kind of specialized training that will eventually help put you in a position to meet your own reasonable needs.
