As the best child custody lawyers in Mesa AZ we often get asked, “what does child custody law include in Arizona?” Today I want talk to you about what is probably the most emotional issue that any couple deals with when going through a divorce here in Arizona and that is custody of their children. Now custody in a legal sense is probably one of the most misunderstood issues that any couple deals with. Custody, I think in a lot of people’s minds, is who gets to have the children and where do they live? Well that’s part of it, but really legal custody in Arizona deal specifically with which parent gets to make important decisions about the children? Things like education, medical decisions, religious decisions, those are the most common issues that we talk about when it comes to custody.
There are a couple of different types of custody. There’s sole custody where one parent would be assigned by the court to make all those decisions really without any input from the other parent. The most common type of custody, legal custody, is joint custody where both parents, although divorced, would continue to make those important decisions together. Now you can imagine, that often leads to some difficulty between the parents, after all, they’re getting divorced for a reason. But most courts in Arizona prefer that the children have two parents who obviously love and care about them, making these important decisions. There are a lot of different factors that the court must consider when determining whether a party will get sole custody or whether the parents will share joint legal custody going forward. Those factors really require an experienced Arizona family law attorney to guide you through those issues that the court’s going to have to address. They include things such as which parent is going to be most likely to share that custody, what does the child want, etc.
These are complicated issues, they’re emotional issues and I really encourage anyone who’s going through divorce or contemplating divorce to consult an experienced Arizona family law attorney to help guide them through these issues. Here at the law offices of Kevin Jensen, we’ve been doing this for many, many years. We’ve helped many, many couples, many, many people deal with the custody issue.
